1. ACCEPTANCE OF TERMS AND CONDITIONS
The following are terms of a legal agreement between “Members” of this website and Bearingtrends.com. Use of this site (“Site”) constitutes your acceptance of these terms and conditions which take effect on the date your account is established on the Site. Bearingtrends.com reserves the right to change or modify these terms and conditions at any time by posting the modified terms and conditions on the Site. You are responsible for reviewing on a regular basis the information posted online to obtain timely notice of such changes. Your continued use of the Site after changes are posted constitutes your acceptance of this agreement as modified by the posted changes.

2. MEMBER ACCOUNT REGISTRATION
Registered Members of beairngtrends.com are entitled to List, Sell, and Source Bearings & Power Transmission items on the bearingtrends.com site. Companies or individuals may become a Member of bearingtrends.com by completing an account registration on the site. Depending on the promotion at that time the member would be able to register and become a part of Bearingtrends.com.” However, bearingtrends.com reserves the right to implement a nominal membership fee for Registered Members at any time in the future. In the event bearingtrends.com elects to implement a membership fee for Registered Members, the fee will be based on the overall usage of the specific Member. The Member will be notified in writing prior to the implementation of any such membership fee. In the event a Registered Member elects not to pay the implemented membership fee, the specific Premium Member‘s account status will be changed and the login to the website will no longer be valid. If a member wishes to terminate the account prior to the stipulated time for which the membership was granted, Bearingtrends.com can charge a nominal “Transaction and Cancellation Fee”.

In the event of the system being inoperative for any reason, either locally or throughout the system, this will not be deemed as being a failure by Bearingtrends.com to honour the contract. The Member will however be entitled to a rebate of monthly fees on a pro-rata basis for the time they are unable to access the system due to server faults with Bearingtrends.coms server, but no responsibility is accepted for failures that are beyond Bearingtrends.coms control, for example, a failure by the members internet service provider, or Internet links outside Bearingtrends.coms control. Bearingtrends.com will be entitled to fees as agreed. Fees are payable as agreed in advance, commencing with a first payment due as agreed. The member has the right to cancel this agreement after notice of termination of one month. Any fees which have been overpaid are subject to repayment within one month. As stated earlier for termination of any contract a Cancellation fee might be applied.

3. MEMBER BUYER RESPONSIBILITIES
Members who register an account to purchase inventory listed on the Site are required to give true and accurate information on their account registration form. The establishment of a Member account with the Site does not automatically extend “open payment terms” for inventory purchased. Payment for product purchased on the Site will be subject to the payment terms and conditions of the specific Supplier that is supplying the product. All inventory purchased by the Member through the Site will be invoiced by the specific Supplier that is supplying the product. Any problems arising from the purchase of inventory through the Site, including but not limited to, defective or inferior product, product lost or damaged in shipping, shipping costs, pricing errors, shipping errors, shipping delays, and product returns is the responsibility of the specific Buyer and Supplier to resolve. The Buyer agrees to exclude Bearingtrends.com from any financial responsibility for any problems arising from the purchase of any inventory on the Site.

4. MEMBER SUPPLIER RESPONSIBILITIES
Members who register an account to list and supply inventory on the Site are required to give true and accurate information on their account registration form. In addition, the Supplier agrees to give complete and accurate information on the inventory they list on the Site, such as but not limited to Part Numbers, Descriptions, Brand/Manufacturer, Quantities, Packaging, Price, etc. The Supplier agrees to maintain the inventory they list on the Site and endeavor to keep their information correct and updated. The Supplier agrees that the inventory they list and advertise is legally in their possession or readily available to them and is available for immediate shipment, unless otherwise noted. The Supplier agrees that the product they list and supply is in new condition, never before used, and free from all known defects, unless otherwise specifically noted. The Supplier further agrees to stand behind the quality and condition of the product they supply. The Supplier agrees to respond promptly to all product inquiries generated by the Site. All inventory sold by the Supplier through the Site will be invoiced by the Supplier. The Supplier agrees that they alone are responsible for the collection of monies owed for any product sold by them to any Buyer of the Site, thereby excluding Bearingtrends.com from any financial responsibility arising from the failure of Supplier to collect monies owed to them for any product sold. Any problems arising from the sell of inventory through the Site, including but not limited to, defective or inferior product, product lost or damaged in shipping, shipping costs, pricing errors, shipping errors, shipping delays, and product returns is the responsibility of the specific Supplier and Buyer to resolve. The Supplier agrees to exclude Bearingtrends.com from any financial responsibility for any problems arising from the sell of any inventory on the Site.

6. MEMBER ACCOUNT SUSPENSION AND TERMINATION
Bearingtrends.com reserves the right to suspend and ultimately terminate the account of any Member on the Site which are found to be in violation of the terms and conditions contained herein. In the event a suspension is warranted, Bearingtrends.com will notify the violating party in writing outlining the reason(s) for such suspension. The violating party will then be given an opportunity to correct and remedy such violation, thereby having their account on the Site reinstated. In the event that the violating party fails to correct or remedy the violation to the satisfaction of Bearingtrends.com, the account of the violating party will be terminated from the Site and the violating party will be notified of such termination in writing.. The terminated party will then have the right to appeal the termination decision in writing to Bearingtrends.com for reconsideration. The reconsideration shall be conducted by Bearingtrends.com in their timing and at their discretion. Any decision reached by Bearingtrends.com through reconsideration shall be considered final.

If there is any conflict between these Terms and Conditions and rules and/or specific terms of use appearing on this site relating to specific material then the latter shall prevail.

If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
If these Terms and Conditions are not accepted in full, the use of this site must be terminated immediately
